Mark Pendleton Memorial - UPDATE - No Plea Bargain Offered

Prosecutors have backed away from offering a plea agreement to an El Sobrante man charged in the hit-and-run death of Mark Pendleton in 2008 along McEwen Road in Contra Costa County. Assistant district attorney Paul Sequeira said Monday that after speaking with the victim's family, his office decided to cease discussions about a plea deal for Harold Brown, 54. Brown is accused of striking 49-year-old electrician and Martinez resident Mark Pendleton the night of Nov. 24, 2008, and then fleeing the scene in his vehicle. His next court hearing is scheduled for Sept. 9, 2010.

Mark Pendleton (49) regularly enjoyed rides from his home in Martinez on beautiful roads thoughout the East Bay. Mark was the victim of a hit and run crash after climbing McEwen Road on Monday, November 24, 2008. An updated news report about this generous individual and CHP's effort to find the northbound motorist, who crossed into the oncoming lane, appeared in the Contra Costa Times newspaper on 11/26/08 and on 12/11/08. The initial article includes a photo of Mark.

EBBC placed a ghost bike on McEwen Rd, about 3/10 mile north of the intersection with Franklin Canyon Road. We invite bicyclists help the family bring closure to this tragic loss as we recognize Mark and build pressure to bring justice and a quick resolution to this tragedy. We ask any visitors in vehicles to stop in the shoulder area immediately before the road narrows, otherwise, there are very few locations on the narrow and steep McEwen Rd to turn around.

The SF Chron reported on the arrest of Harold Brown, but in typical fashion the report cast blame on the victim. A fair account appeared in the CoCo Times. The initial investigation determined that Mark's killer had crossed over the center line to cause the collision before fleeing the scene. EBBC first learned from the family that Harold Brown was arrested on June 2, 2009 and we sent the following note in reply.

Dear Denise, Paul and John:

On behalf of the East Bay Bicycle Coalition and Board of Directors (copied), I share our relief that this emotional burden is finally removed from your shoulders. We return our love to you and your family. It may be a bit of premonition, but just yesterday I thought of how difficult it must be for Mark's hit-and-run killer to not talk to somebody over a six-month period. It will be useful to find out if Harold Brown was also involved in removing the ghost bike we initially placed on McEwen Rd on Nov 26, 2008. [twice EBBC joined the Pendleton family & friends to replace the stolen ghost bike and maintain the pressure to find Mark's killer].

Now we want to see that justice is meted out to Harold Brown for killing Mark and fleeing the scene of the crime. We will be available to help continue to shine spotlight on this case. Please don't hesitate to call on us for assistance with legal references, pressure on the DA to file charges, or simply to offer you comfort.

Until I have your permission or direction from your attorney, we will not make public comments on the case.

The heartfelt participation

The heartfelt participation by bicyclists at the Memorial provided solace to Mark's numerous family members who attended. The spirit of Mark's good character was infectious and lives on in all who attended the touching event. The subsequent ride to the ghost bike was led by one of Mark Pendleton's teammates.

Immediately after EBBC contacted Martinez officials to arrange the Memorial, Vice-Mayor Mark Ross encouraged establishing a $5000 reward for information leading to the arrest of the driver. Vice-Mayor Ross, who joined us on the ride yesterday truly deserves the title "honorable." The Contra Costa Times reported on another honorable donation of $5000 by an anonymous donor from the Webcor/Alto Velo Racing Club of Los Altos.

The irresponsible driver who crossed the double-yellow line remains at-large. Perhaps not for long. Identifiable debris from a dark Chevrolet Silverado, GMC Yukon, or Suburban was found at the McEwen Road crash site.

Mark Pendleton Memorial

Thank you for your interest and your support. I love my husband very much and it means more than you can imagine to know that you and many others will be showing your support for him this Saturday. As you are already aware, his funeral is also this Saturday at 1:00 at Connolly and Taylor on Alhambra Avenue in Martinez but I would like for you to let everyone who shows up to the ride know that Mark would have been especially touched to know that you all are doing this for him. I want you to know that Mark was not just a cyclist, he truly was a good man. He loved and cared deeply for me and our sons and I am proud that he was my husband for 28 years. I would like very much to hear how the ride turns out.
